BROKER, NOT A REP. Tact Energy LLC is a registered Texas electricity broker; it does not sell electricity, take title to electric energy, or take customer funds. Affiliated REP: none. B. AUTHORIZED ACTIONS (16 TAC 25.486(g)(2)(A)). In addition to the TDU request above, the Customer authorizes Tact Energy LLC to act as the Customer's client agent to: (a) obtain the Customer's historical and ongoing usage and interval/meter data from the Customer's TDU and from Smart Meter Texas (SMT); (b) register, maintain, and periodically RENEW one or more SMT Energy Data Agreements for the Customer's ESI ID(s); and (c) use this data to solicit, compare, and present competitive REP offers. The Customer's REP will be switched only upon the Customer's separate authorization. C. RELEASE OF PROPRIETARY INFORMATION (16 TAC 25.486(j)). The Customer authorizes Tact Energy LLC, in writing, to release the Customer's proprietary usage information to Retail Electric Providers solely to obtain and compare competitive offers; revocable in writing at any time. D. TERM (16 TAC 25.486(f)(5),(g)(2)(B)). This agency authorization is effective on the e-signature date and continues for 60 MONTHS unless terminated earlier. The Customer understands that Smart Meter Texas caps each data agreement at 12 months (residential/small commercial; up to 36 months large commercial) and requires the Customer's OWN periodic re-acceptance of an SMT email; the Customer authorizes Tact Energy LLC to re-initiate SMT renewals throughout this term and agrees to act on SMT's renewal emails. E. TERMINATION (25.486(g)(2)(C),(D)). The Customer may terminate at any time by emailing info@tact-energy.com; no termination fee. Upon termination, Tact Energy LLC ceases data requests and terminates active SMT agreements. F. DATA HANDLING (25.486(g)(2)(E)). The Customer's data is used solely to shop/manage the Customer's electricity service; protected by reasonable safeguards; retained for the term plus at least two (2) years (25.486(l)); and securely disposed of thereafter except where retention is required by law. G. COMPENSATION (25.486(f)(6)). Tact Energy LLC is paid by the REPs/suppliers it works with; the Customer pays no separate fee. H. ELECTRONIC SIGNATURE (Tex. Bus. & Com. Code Ch. 322 (UETA); 15 U.S.C. 7001 (E-SIGN)). The Customer agrees to transact electronically and that this electronic signature is legally binding, and may request a paper copy. I.
